If you have lost a loved one because of the recklessness or negligence of another, you may be able to pursue a wrongful death claim. Typically, a personal representative will need to be appointed to initiate a wrongful death claim on behalf of the survivors. In most cases, the decedent’s will designate the personal representative. If the decedent did not have a will, the court will appoint the surviving spouse as the personal representative. If the decedent did not have a surviving spouse, the personal representative is typically chosen by a majority vote of the decedent’s heirs.

Under the Florida Wrongful Death Act, the survivors that may be entitled to a claim are the following:

  1. Spouse;
  2. Minor children (under the age of 25);
  3. Adult children (over the age of 25);
  4. Parents;
  5. Blood relatives;
  6. In some cases, adoptive relatives
